GENERAL
1. Overview and Scope
These Terms of Use (“Terms”) govern access to and use of the Destination Design website, including destination.design ( “Site”), as well as all educational workshops, working sessions, advisory consultations, and communications, including newsletter subscriptions (collectively, the “Services”), offered by Destination Design (“we,” “us,” or “our”).
By accessing the Site, registering for a workshop, submitting a consultation inquiry, or subscribing to any Destination Design communication, you (“User” or “Participant”) agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.
These Terms apply in addition to any separate engagement letter or services agreement entered into with Destination Design for advisory, strategy, or deployment work.
2. Intellectual Property
All content on the Site and in the Services—including frameworks, methodologies, tools, copy, graphics, slides, exercises, recordings, and written materials—is the exclusive intellectual property of Destination Design and its principals. This includes, without limitation, the following proprietary marks and frameworks:
- Destination Design Framework™
- Demand Architecture™
- Return on Design™
Nothing in these Terms transfers ownership of any intellectual property to Users. All rights not expressly granted are reserved.
WEBSITE USE
3. Permitted Website Use
You may access and browse the Site for your own personal or professional informational purposes. You may share links to publicly available pages on the Site.
4. Prohibited Website Use
You may not:
- Scrape, crawl, or systematically extract content from the Site by automated means.
- Use any content from the Site to develop competing products, services, or educational materials.
- Misuse contact or inquiry forms, including submitting false information or unsolicited commercial messages.
- Attempt to gain unauthorized access to any part of the Site or their underlying systems.
- Remove or alter any copyright, trademark, or proprietary notices.
5. Third-Party Links
The Site may contain links to third-party websites. These links are provided for convenience only. Destination Design does not endorse and is not responsible for the content, accuracy, or practices of any third-party site. Accessing third-party links is at your own risk.
6. Website Disclaimer
Content on the Site is provided for informational purposes only and does not constitute legal, financial, investment, or professional advice. Destination Design makes no representations or warranties regarding the accuracy, completeness, or fitness for a particular purpose of any content on the Site. We reserve the right to update or remove Site content at any time without notice.
CONSULTATION INQUIRIES
7. No Client Relationship Created
Submitting a consultation request, completing an inquiry form, or participating in a discovery or introductory call does not create a client relationship, engagement agreement, or any obligation on the part of Destination Design to provide services. A formal client relationship is established only upon execution of a written engagement letter or services agreement signed by both parties.
8. Confidentiality of Inquiry Information
Information you share in connection with a consultation inquiry will be used solely to evaluate fit and respond to your request. We will not share your inquiry information with third parties without your consent, except as required by law.
9. Confidentiality of Inquiry Information
Paid advisory, strategy, and deployment engagements—including the Positioning Diagnostic, Destination Intensive, Destination Blueprint, Demand Architecture™, and Return on Design™—are governed by separate engagement agreements that will be provided at the time of engagement. In the event of any conflict between those agreements and these Terms, the engagement agreement controls.
MAILING LIST — THE INTERVENTION
10. Subscription and Consent
By subscribing to The Intervention or any other Destination Design newsletter or communication, you consent to receive periodic email communications from us. Subscription is voluntary. We will not add you to our mailing list without your affirmative opt-in.
11. Content and Use
Newsletter content, including commentary, frameworks, and insights shared in The Intervention, is the intellectual property of Destination Design. Subscribers may share individual issues with proper attribution but may not reproduce, republish, or commercialize newsletter content without prior written permission.
12. No Professional Advice
Newsletter content is provided for general informational and educational purposes only. It does not constitute professional advice of any kind and does not create a client or advisory relationship.
13. Unsubscribe
You may unsubscribe from our mailing list at any time by clicking the unsubscribe link included in every email, or by contacting us at inquiry@destination.design. We will process your request promptly and you will not receive further communications from us following opt-out, except as required to fulfill a prior request or as required by law.
14. CAN-SPAM Compliance
In compliance with the CAN-SPAM Act, all commercial email communications from Destination Design will: accurately identify the sender; include a clear subject line; include our physical mailing address; and provide a functioning unsubscribe mechanism. Our mailing address for this purpose is:

WORKSHOP PARTICIPATION
15. Permitted Use of Workshop Materials
Subject to these Terms, Participants are granted a limited, non-exclusive, non-transferable license to:
Apply the frameworks and concepts presented in the Workshop internally, within your own firm or practice, to inform strategic decisions on projects where you are the primary practitioner.
Reference Workshop concepts in conversations with clients, provided that attribution to Destination Design is included and that Workshop Materials themselves are not reproduced or distributed.
Retain personal notes and summaries created during the Workshop for your own professional use.
16. Attribution Requirements
When referencing the Destination Design Framework™ or any Workshop concept in published work, presentations, client deliverables, or public communications, Participants must include clear attribution in the following or substantially similar form:
“Based on the Destination Design Framework™, developed by Destination Design (destination-design.webflow.io).”
Attribution must be visible and legible and may not be obscured, minimized, or omitted in any published or client-facing material.
17. Prohibited Uses of Workshop Materials
Without prior written permission from Destination Design, Participants may not:
Reproduce, copy, scan, photograph, record, or otherwise duplicate Workshop Materials in whole or in part.
Distribute, share, post, publish, or transmit Workshop Materials to any third party, whether in original or modified form, by any means—including email, social media, file sharing, or public platforms.
Use Workshop Materials to develop, teach, or facilitate competing workshops, curricula, training programs, or educational offerings.
Sublicense, sell, rent, or otherwise commercialize Workshop Materials or derivative works thereof.
Present or claim any Workshop concept or framework as original work developed independently by the Participant.
18. Confidentiality Among Participants
Workshops are conducted in a private, invitation-only setting. Participants agree to keep confidential any non-public information shared by other Participants during a Workshop, including project details, business strategies, and financial information. This obligation survives the conclusion of the Workshop.
19. Workshop Access and Conduct
Workshop invitations are non-transferable. Participants may not share login credentials, access links, or recordings with individuals who have not been accepted and registered. Destination Design reserves the right to remove any Participant from a Workshop, without refund, if their conduct is disruptive, disrespectful, or inconsistent with these Terms.
LEGAL
20. Disclaimer of Warranties
The Site and Services are provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Destination Design does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
21. Limitation of Liability
To the fullest extent permitted by law, Destination Design and its principals shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Site or Services. Destination Design’s total liability to any Participant shall not exceed the amount paid by that Participant for the specific Service giving rise to the claim.
22. Remedies for Breach
Destination Design reserves the right to seek injunctive relief, damages, and any other remedies available at law or in equity in the event of a material breach of these Terms. Unauthorized use or distribution of Workshop Materials may constitute copyright infringement and could give rise to civil and criminal liability.
23. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Washington State.
24. Modifications to These Terms
Destination Design reserves the right to update these Terms at any time. Material changes will be posted on the Site and, where applicable, communicated to registered Participants before the relevant Service begins. Continued use of the Site or Services following notice of changes constitutes acceptance of the updated Terms.
